Welcome to TomDum. By accessing or using tomdum.com ("the Service"), you agree to be bound by these Terms of Service. Please read them carefully. If you do not agree, you may not use the Service.
1. About TomDum
TomDum is a local business discovery and review platform for Kathmandu Valley, Nepal. It allows users to find businesses, read and write reviews, share posts, and for business owners to claim and manage their listings.
2. Eligibility
You must be at least 13 years old to use TomDum. By using the Service you represent that you meet this requirement. If you are using TomDum on behalf of a business, you represent that you have the authority to bind that business to these Terms.
3. User Accounts
You may register using your email address or via Google or Facebook sign-in. You are responsible for maintaining the security of your account and for all activity that occurs under it. You must not share your login credentials with others. Notify us immediately at [email protected] if you suspect unauthorised access to your account.
4. User-Generated Content
Your content
You retain ownership of the reviews, posts, and photos you submit. By submitting content to TomDum, you grant us a non-exclusive, royalty-free, worldwide licence to display, distribute, and promote that content on the platform and in connection with the Service.
Content standards
You agree that content you submit will not:
- Be false, misleading, or defamatory
- Contain hate speech, harassment, or threats against any individual or group
- Violate the privacy or intellectual property rights of others
- Include personal information of others without their consent
- Constitute spam, fake reviews, or paid/incentivised reviews not disclosed as such
- Contain illegal content under Nepalese law
We reserve the right to remove content that violates these standards without prior notice.
5. Reviews and Ratings
Reviews must be based on genuine first-hand experience with the business. One review per user per business is allowed. Business owners may not post reviews of their own businesses or arrange for others to post fake reviews. We reserve the right to investigate and remove reviews we reasonably believe to be inauthentic.
6. Business Listings and Claims
Listings
Business information on TomDum is sourced from publicly available data and may be supplemented by the business owner after claiming. We do not guarantee the accuracy of any listing.
Claiming a business
Only an authorised representative of a business may claim it. By submitting a claim you confirm you have authority to manage that business's presence online. Fraudulent claims will result in immediate removal and possible legal action.
Delisting
Business owners may request removal of their listing at any time via the delist flow. Aggregate review data may be retained in anonymised form after delisting.
7. Prohibited Conduct
You may not:
- Scrape, crawl, or otherwise extract data from TomDum in bulk without written permission
- Attempt to gain unauthorised access to any part of the Service or its infrastructure
- Use the Service to send unsolicited messages or advertisements to other users
- Create multiple accounts to circumvent bans or posting limits
- Reverse-engineer, decompile, or attempt to extract the source code of TomDum
- Use the Service for any illegal purpose under Nepalese or applicable international law
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
8. Intellectual Property
The TomDum name, logo, design, and original content on the platform (excluding user-submitted content and business information sourced from third parties) are owned by TomDum and are protected by copyright and trademark law. You may not use them without our prior written consent.
9. Business Photo Attribution
Some business photos displayed on TomDum are sourced from Google Maps and are owned by their respective contributors. These photos are displayed under the terms of the platform they originate from. Business owners may upload their own photos by claiming their listing.
10. AI-Generated Summaries
TomDum displays AI-generated summaries of businesses based on user reviews. These summaries are produced automatically and may not be fully accurate. They are provided for informational purposes only and should not be treated as professional advice. Business owners who believe a summary is materially incorrect may contact us to request a review.
11. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:
- Business information (addresses, phone numbers, hours) is current or accurate
- The Service will be uninterrupted, error-free, or secure
- Reviews or ratings accurately reflect a business's quality
Always verify critical information (such as business hours or medical advice) directly with the business before making decisions.
12. Limitation of Liability
To the maximum extent permitted by law, TomDum shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service — including but not limited to loss of revenue, loss of data, or reputational harm — even if we have been advised of the possibility of such damages.
Our total liability for any claim arising out of or relating to these Terms shall not exceed the amount you paid us in the past twelve months (which, as TomDum is a free service, is NPR 0).
13. Indemnification
You agree to indemnify and hold TomDum and its team harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms.
14. Termination
We may suspend or terminate your account at any time for violation of these Terms, with or without notice. You may delete your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately, but provisions that by their nature should survive termination will do so (including Sections 8, 11, 12, and 13).
15. Changes to These Terms
We may update these Terms from time to time. We will notify registered users of material changes by email or by a prominent notice on the platform. Continued use of TomDum after changes are posted constitutes acceptance of the revised Terms.
16. Governing Law
These Terms are governed by the laws of Nepal. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Kathmandu, Nepal.
